Yes, and it's most of what we do. We're the attorney you or your board can call without adding someone to staff.

Incorporation creates your organization under state law. 501(c)(3) status is a separate IRS approval that exempts a nonprofit corporation from federal income tax. With the exception of churches, a nonprofit is generally not tax-exempt until the nonprofit applies for exemption and the IRS issues an IRS determination letter.

Possibly. More than half of states require a charitable solicitation registration before you ask for donations there, separate from your incorporation or 501(c)(3) status. Contact us, and we can help you determine your legal obligations, and we can apply for an exemption or a license to solicit in any state requiring it.

Yes. File your 501(c)(3) application within 27 months of forming, and donations made in the meantime become deductible once the IRS approves you. File late, and deductibility may only start from your filing date.
