  • Advantages to Incorporating a Non-Profit Organization

    A non-profit organization should be formed as a corporation for a number of reasons:

    Incorporating a non-profit helps to protect the founders and staff against liability for accidents or frivolous lawsuits pertaining to the religious, charitable, or educational activity of the non-profit. 

    A corporation is not limited in its lifespan. A corporation can continue to exist legally, even after its founder, directors, or officers die or move on.

    Unincorporated non-profits may not be allowed to accept tax deductible donations.

  • Should a Non-Profit Be Established as an LLC

    No.  While there are some limited circumstances when an existing non-profit corporation may establish an LLC, a new non-profit organization should be established as a corporation.  Limited liability companies are not an appropriate legal form for a church, charity, school, etc.
